Affiliate Terms of Use

Introduction

As an authorised Affiliate (“Affiliate”) of TenaZ, you agree to abide by the Terms of Use outlined in this Agreement. Please review the entire Agreement carefully before registering and promoting TenaZ Products.

Your participation in the Affiliate Program (“Program”) is intended solely for the legal promotion of the TenaZ website with its products, enabling you to earn commissions on products purchased by individuals referred to TenaZ via your website, social media or personal referrals.

By signing up for the TenaZ Affiliate Program, you acknowledge and agree to the terms and conditions of this Agreement.

Product Promotion

The TenaZ Affiliate System is a marketing platform that allows individuals or businesses (“Affiliates”) to promote TenaZ products or services in exchange for commissions on sales generated through unique referral links provided by the Affiliate Program. The system automatically tracks clicks, referrals, and sales, and calculates commissions based on verified transactions in accordance with the terms of this Agreement.

The Affiliate acknowledges and agrees that it is solely responsible for sourcing its own leads and promoting TenaZ products through lawful means, including but not limited to websites, social media, and email marketing. The Affiliate’s entitlement to commissions is contingent upon the successful referral of customers who complete purchases through the Affiliate’s promotional efforts.

Affiliate Process Steps

Registration: Sign up for the TenaZ Affiliate Program by completing the online registration form with your details. Ensure that all required information is accurately provided.
Approval: After submitting your application, it will be reviewed by the TenaZ team. Once approved, you will receive an email confirmation with your unique affiliate link and access to the affiliate dashboard. Allow for at least 5 working days to conclude the process. If no response send a message via WhatsApp.
Training: Upon approval, you will have access to training materials, resources, and guidelines to help you effectively promote TenaZ products. This includes best practices for using your dashboard, and affiliate links, understanding the products, and maximising your earning potential.
Promoting the Products: Start promoting TenaZ products through your affiliate link on your website, social media, email marketing, or other platforms. Track your referrals and earnings through the affiliate dashboard, and ensure compliance with the program’s terms and conditions while advertising.

Approval or Rejection of Application

TenaZ reserves the right to approve or reject any Affiliate application at our sole discretion. The Affiliate shall have no legal recourse for the rejection of an application.

Affiliate System

An affiliate system allows individuals or businesses to promote a company’s products or services using unique referral links in exchange for commissions on sales. It operates automatically by tracking clicks and purchases through cookies, ensuring that sales are accurately attributed to the affiliate. The system is secure, with real-time monitoring, fraud prevention, and automated payments based on completed transactions, providing a safe and efficient way for affiliates to earn commissions.

Commissions

Commissions are calculated and paid out monthly, so affiliates receive their earnings once every month on the 25^th of the month. If the date falls on a public holiday or weekend it will be paid the day before the weekend.
To qualify for a commission, the account that was referred by the Affiliate must remain active for at least 31 days. This ensures that the referred customer is genuinely using the service, reducing the risk of fraudulent sign-ups or quick cancellations.
The affiliate is not allowed to refer themselves, meaning they cannot earn a commission by signing up for TenaZ’s services through their own referral link. No commission will be paid for accounts linked to the Affiliate themselves.
Commissions are only paid for successful, completed transactions. If a transaction is cancelled, results in a chargeback or the customer requests a refund, the Affiliate will not receive a commission for that transaction.
The Affiliate agrees to provide banking details for the purpose of receiving commission payments once the system confirms active promotion of TenaZ products through an active account. TenaZ will securely collect the Affiliate’s banking details to deposit commissions into the Affiliate’s personal or business account.

Termination

Your Affiliate status may be suspended or terminated for any of the following reasons:

Posting inappropriate advertisements (false claims, misleading hyperlinks, etc.)
Engaging in spamming activities (mass email, mass newsgroup postings, mass messaging, etc.)
Advertising on websites that contain or promote illegal activities
Violating intellectual property rights. TenaZ reserves the right to require a license agreement for any use of its trademarks to protect its intellectual property
Offering unauthorised rebates, coupons, or kickbacks from your affiliate commission as an incentive. Adding bonuses or bundling other products with TenaZ offerings is permitted
Self-referrals, fraudulent transactions, or suspected affiliate fraud

In addition to the above, TenaZ reserves the right to terminate any Affiliate account at any time, for any violation of this Agreement or for no reason.

Affiliate Links

You may use text and graphic links on your website, social media, and in email communications. You may also promote TenaZ in online or offline media such as classified ads, magazines, and newspapers. You may use the graphics and text provided by TenaZ or create your own, provided they are appropriate and in line with this Agreement.

TenaZ offers the Affiliate Platform and products but holds no responsibility for any costs the Affiliate may incur while promoting their referral links.

Coupon and Deals

TenaZ may provide coupons to select Affiliates. If you are not pre-approved to promote a branded coupon, you are prohibited from promoting it. The following terms apply to coupon promotions:

You may not use misleading text or graphics on affiliate links to imply unauthorised deals
You may not bid on keywords such as “TenaZ Coupons” or “TenaZ Discounts” without prior approval
You may not generate pop-ups, pop-unders, iframes, or any other automatic actions that set affiliate cookies unless the user has explicitly expressed an interest in a specific deal
Your link must lead directly to the TenaZ website, and any coupon information must be visible before setting an affiliate cookie
“Click to see Deal/Coupon” links without available coupons are not allowed, and Affiliates found using such tactics will be removed from the Program

Pay Per Click (PPC) Policy

PPC bidding is prohibited unless you have prior written permission from TenaZ.

Laws and Regulations

The Affiliate agrees to comply with all applicable South African laws and regulations, including but not limited to the Consumer Protection Act (CPA), the Electronic Communications and Transactions (ECT) Act, and the Protection of Personal Information (POPI) Act.

The Affiliate agrees to handle any personal information obtained through referrals or any marketing efforts in strict compliance with the POPI Act. The Affiliate is prohibited from using any personal data for purposes beyond what is outlined in this Agreement without obtaining proper consent from the data subject.
The Affiliate is responsible for complying with all relevant tax laws in South Africa, including VAT or income tax obligations arising from commissions earned through the Program. TenaZ shall not be liable for any tax liabilities or declarations on behalf of the Affiliate.
This Agreement shall be governed by and construed in accordance with the laws of South Africa. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of South Africa.
The Affiliate agrees to comply with the provisions of the Consumer Protection Act (CPA) in all marketing and promotional activities. Any false or misleading claims or practices that violate the CPA will be grounds for immediate termination of this Agreement.

Liability

TenaZ is not liable for any indirect or incidental damages, such as loss of revenue or commissions, resulting from tracking failures, database issues, or any harm to the Program or our website. We do not guarantee the Affiliate Program’s operation will be error-free and are not responsible for interruptions or errors.

Term of the Agreement

This Agreement begins when your affiliate account is approved and will remain in effect until your affiliate status is terminated.

We may modify the terms of this Agreement at any time. Should you find any modifications unacceptable, your only option is to terminate your affiliate account. Your continued participation in the Program constitutes your acceptance of any changes.

Copyright

All materials provided by TenaZ, including text, graphics, and images, are protected by copyright and intellectual property laws.

Affiliates are granted a non-exclusive, non-transferable license to use these materials solely to promote TenaZ.

Unauthorised reproduction, distribution, or use of any TenaZ materials for purposes not authorized under this Agreement is strictly prohibited.

Indemnification

The Affiliate agrees to indemnify and hold harmless TenaZ, its affiliates, subsidiaries, officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising out of the Affiliate’s actions or omissions, including negligence, misrepresentation, failure to disclose, or intentional misconduct.

Electronic Signatures

This Agreement constitutes an electronic contract that sets forth the legally binding terms of your participation in the TenaZ Affiliate Program. By completing the application process, you consent to this Agreement and its terms, creating an electronic signature with the same legal effect as a handwritten signature.
